Over 400 Complaints Registered With TN RERA

The Tamil Nadu Real Estate Regulatory Authority (TNRERA) is set to address as many as 430 complaints that it has recently received from homebuyers. The authority was established in June last year after the Tamil Nadu government notified and approved the Tamil Nadu Real Estate (Regulation & Development) Rules, 2017, for implementation of the provisions of the Real Estate (Regulation & Development) Act, 2016.

Among the complaints received, 10 have been finalised while others are under inquiry. The highest number of complaints pertain to delay in project delivery. Most of these buyers want the developers to refund and compensate them for the stalled projects.

The regulatory authority has been actively tracking errant developers since its inception. For instance, in 2017, it issued notices to 29 of its registered housing projects for remaining incomplete yet being listed among 204 real estate ongoing projects that had filed applications to be structurally completed.  In 2017, there were 147 complaints registered with the TNRERA. However, the cases were pending with the authority due to staff crunch. So far, the state authority has ordered the refund of booking amount of Rs 4 lakh to only one buyer. 

Meanwhile, the TNRERA has issued show-cause notices to 1,250 projects which are not yet registered with the regulator. About 657 projects have been registered under the TNRERA. The authority has also requested the Registration Department to monitor the sale of projects by 250 builders, who claim their structures are for their own use.

 

Regularised layouts to come under TNRERA

In a recent decision by the authority, unauthorised layouts which were regularised under the amnesty scheme will soon come under the ambit of the Real Estate Act. The TNRERA has requested the commissioner of town and country planning to direct layout promoters, who have applied for regularisation under the scheme, to approach the realty regulator for registration of register such layouts.

The move intends to safeguard buyers’ interest as they can raise a complaint with TNRERA in the event of any discrepancy with the plots, say if the promoters subdivide the plots, thus deviating from the sanctioned approvals.
